Personal Injury Lawsuit Against Seroquel Thrown Out

A Delaware judge has thrown out a personal injury lawsuit against AstraZeneca PLC on the ground that the plaintiff’s medical expert did not sufficiently establish that the anti-psychotic drug Seroquel caused a woman to develop Type II diabetes.

The Delaware ruling, which granted the company’s summary judgment motion, was the third tossing out a personal injury lawsuit involving Seroquel.  In January, U.S. District Court Judge Anne Conway who has been overseeing the multidistrict litigation against AstraZeneca, granted summary judgment on similar ground in the first two personal injury cases involving Seroquel.  Those two cases had different medical experts.

“In the cases prepared for trial to date, plaintiffs have been repeatedly unable to prove their claims in court,” said Tony Jewell, a spokesman for AstraZeneca.  “The evidence — looked at fully and fairly — just doesn’t back up the allegations that Seroquel was responsible for the plaintiffs’ alleged injuries.”

The plaintiff, a black woman who was overweight for most of her life, was diagnosed in 2004 with Type II diabetes after taking Seroquel as an off-label sleeping aid for 12 months.  Some 17,000 people have pending products liability cases against AstraZeneca over the prescription drug Seroquel.
