Pharmaceutical Liability Might Go Unchecked In Michigan

A group of Michigan residents are looking to repeal a ban on pharmaceutical malpractice lawsuits within their state, the only one in America where it is illegal to sue a drug company for pharmaceutical liabliity.

We, as personal injury attorneys in San Diego, believe that it is important for pharmaceutical manufactures to disclose all potential hazards of their products to ensure consumers that they are not at risk of product liability.  Drug companies who make defective products can cause an immense amount of pain and suffering, especially if their actions lead to someone’s wrongful death.

Since 1996 Michigan law has prohibited its citizens from suing pharmaceutical companies for malpractice and defective products unless there is proof that the company committed fraud, bribed or withheld research data from the Food and Drug Administration (FDA).

“Anyone who sees there is no other state with a law like Michigan’s must conclude either all the other 49 states are wrong or Michigan is wrong…I think it’s the latter,” said Dr. Sidney Wolfe, director of Public Citizen’s Health Research Group.

Malpractice lawsuits provide another review of drugs and makes sure pharmaceutical companies are held accountable for product liability even after the FDA has approved the drug that is on the market.

We believe that Michigan’s immunity law for pharmaceutical malpractice is the most restrictive in the nation because a lot of bioscience companies have set up shop in the Great Lake State, contributing $9.34 billion to the state’s economy and accounting for nearly 100,000 jobs, as of 2006.

Now the state officials are being asked which is more important—the health of their citizens or the health of their local economy?
