Sanofi-Aventis Settlement Ends Medical Bill Argument

Sanofi-Aventis, the third largest pharmaceutical sales company, has agreed to pay a settlement in a lawsuit alleges the company overcharged state Medicaid programs for nasal sprays.  The nasal sprays in the lawsuit are Azmacort, Nasacort and Nasacort AQ.

The settlement pays off charges between 1995 and 2000 that Aventis Pharmaceutical Incorporated knowingly misreported its best drug medical bill prices to Medicaid programs.  Under law, drug makers are required to report the best prices for their drugs and give those to Medicaid.

Our firm’s San Diego personal injury attorneys know the importance of proper prices for medical treatments.  When consumers need the products to correct problems with their health, assigning the right price is necessary to make sure medical bills are correct when doctors prescribe these drugs.

Misleading state programs like Medicaid make it more difficult on people who need medications like these, and improperly reported prices make medical bills higher than they should be.

The Justice Department said Aventis altered its “best price” numbers for the nasal sprays by entering into an agreement with the HMO Kaiser Permanente that repackaged Aventis’ drugs under a new label.

“When a drug company agrees to be a provider to the Medicaid programs, it agrees to sell its drugs to them at the same price it gives its best customers,” said Michael J. Loucks, the acting U.S. attorney in Massachusetts.

As pharmacuetical medical malpractice attorneys, we are aware that drugs to treat personal injury are very high and that leads to high medical bills when doctors prescribe medical treatment.  It is necessary for pharmaceutical companies to assign proper prices so patients get the right costs charged for medical bills.

Why should you have to pay more money than you are supposed to for treatments in personal injury?
