Judge Allows Asbestos Lawsuit To Proceed

A judge in Montana agreed to allow an asbestos lawsuit to continue in a case that former employees of a mining company.  These former employees who developed personal injury conditions as a result of working with asbestos are awaiting a possible settlement from the case.

Judge Donald Molloy said he would not throw out the testimony of Robert H. Locke, the government attorney’s star witness, who was a former executive of the chemical products of the asbestos company W.R. Grace.

Asbestos corporate attorneys accused government attorneys of allowing Locke to give perjured testimony in the another personal injury asbestos lawsuit case.  Our personal injury attorneys in San Diego have great disappointment in the government attorneys of Montana.  A proper settlement should be obtained for workers with permanent conditions after working with asbestos.

“The truth of the matter is that we just dropped the ball,” said Tim Racicot, an assistant United States attorney.  Judge Molloy said he would allow Mr. Locke to be recalled before the jury so that defense lawyers may challenge his credibility in the asbestos lawsuit case.

Our firm’s San Diego personal injury attorneys are pleased to hear this asbestos lawsuit case will continue so the maximum settlement possible can be given to workers affected from conditions that are the result of exposure to asbestos.

Hopefully, government attorney mistakes will not lead to these former employees getting left to deal with their asbestos related conditions without a proper settlement.
