Though Toyota Motor Company is trying to remedy the unintended acceleration problem in their cars, there is one family who cannot forget about the wrongful deaths that the company’s car caused them.
The relatives of the late CHP officer Mark Saylor, who was killed with his family a Santee car accident last summer, have filed a lawsuit against Toyota and the Bob Baker Dealership in El Cajon, according to SDNN. Saylor and his family’s accident has drawn national attention for a design defect in Toyota gas pedals that causes them to be stuck in the accelerated position.

Saylor’s extended family members filed the lawsuit on March 2, 2010 against not only Toyota for product liability, but also Bob Baker Lexus for negligence. The 2009 Lexus ES350 sedan that Saylor drove the morning of his fatal car accident was loaned to him by the El Cajon dealership. Saylor had brought his car to be serviced there.
An unspecified amount of money is sought in the lawsuit, one of many which might be rolled into a class action suit on the federal level if approved by a San Diego judge on March 25, 2010. Toyota has issued a safety recall and the House Oversight and Government Reform Committee in Washington, D.C. is also conducting an independent investigation.
