The investigation into the cause of several brain tumors around Cameron, Missouri, took an unexpected turn when a lawsuit—headed by environmental activist Erin Brockovich—was filed that accused a tannery of being liable for personal injury.
Our firm’s personal injury lawyers in San Diego see situations all the time where injured persons develop symptoms without even knowing that a personal injury caused them. Perhaps they think it is a “natural occurrence.” Our concerns with personal injuries such as these have to do with gradually worsening conditions with increased pain and suffering, emotional trauma, or, as with this instance, products liability caused traumatic brain injuries (brain tumors).
This products liability case proves just how severe personal injury cases can become. For years, farmers from four counties in northwest Missouri have used sludge as an agriculture fertilizer for their crops because it was rich in nutrients and free of cost, but they never thought it would lead to personal injuries or brain tumors.
The sludge, according to the personal injury lawsuit, was produced at the Prime Tanning Corporation in St. Joseph, Missouri and contains hexavalent chromium, a known cancer causing agent, in high level doses.
The lawsuit is being filed on behalf of William Kemper, whose wife, Karen, suffered a wrongful death from her personal injury, and Janet Lasher, who saw a rapid development in her personal injury. Karen Kemper passed away in May, 2008 due to complications from her brain tumor. Janet Lasher was diagnosed with lung cancer that spread to her brain. Both women were exposed to polluted air, heavy with hexavalent chromium, from large amounts of sludge that were being used on farmlands by their workplaces and homes.
