$14.1 Million Wrongful Death Lawsuit Goes To Appeal

A Nevada Supreme Court panel will hear the appeal of a $14.1 million wrongful death lawsuit involving a drunk-driver, employed by Terrible Herbst, who crashed into Rosa Delgado, killing her as she was trying to enter her vehicle on a downtown street.

What the Delgado family is trying to drive home is the fact that Darwin Ellison, the temporary employee who was only held a quarter percent liable for the incident, has had three drunk-driving accidents in the past, all of which Terrible Herbst knew about.  He is currently serving five to 20 years in prison for vehicular manslaughter.

The element that has really put this case into a tailspin and keeps holding up a final verdict is that each time it goes to appeal, attorneys on both sides are accusing the judges of being either negligent or biased to one party over the other.  This can be emotionally traumatic for injured parties who are awaiting compensation or need help in paying their medical bills.
