Wrongful Death Linked To VH1 Leads To $6.5M Settlement

The companies that created the VH1 reality show “Rock of Love with Brett Michaels” agreed to a wrongful death settlement of $6.5 million, which was given to the family of a college student.

Kevetta Davis, a sophomore at Southern Illinois University, was a passenger going north on Interstate Highway 57 when she was killed in a fatal truck accident, when truck driver Dennis Hernandez was transporting a semi truck full of equipment headed to the next “Rock of Love” taping.

According to officials, Hernandez fell asleep at the wheel, crossed the road and hit the car being driven by Yasmin Jackson with Davis in the passenger seat.  Our semi truck accident attorneys believe this accident shouldn’t have happened because there is one thing all drivers need before they get behind the wheel: rest.

Drowsy driving can be caused by truckers who can be under a lot of pressure to deliver their cargo on time.  Unfortunately, these same truckers can be under so much pressure, they do not get enough sleep to stay awake and alert behind the wheel.  Driver fatigue can lead to a car accident that causes injuries like whiplash or spinal cord injuries.  In this case, this trucker’s drowsy driving caused the wrongful death of a college student.

Hernandez, who worked for 51 Minds Entertainment, was cited for several offenses which included driving with a suspended license.

Davis’ parents filed a lawsuit against Viacom Entertainment, VH-1 Music, 51 Minds Entertainment and Hernandez less than a month after the car accident, and a Cook County judge approved the settlement agreement swiftly according to attorneys.

“The case moved very quickly and … I think everybody understood that fault was pretty obvious here,” said one of the lawyers for the plaintiffs.

Our semi truck accident lawyers are aware that sometimes people just make mistakes or they overestimate their abilities.  Maybe Hernandez thought he was okay to drive his truck with the amount of sleep he had.  Sometimes, a person’s judgment can be off, but this time, the wrongful death of a college student early in her collegiate career could have been prevented.
