Emotional Distress Due to a Car Accident

“Emotional distress” usually only concerns the people in a car accident.  The recovery for this injury is combined with pain and suffering, called “general damages,” discussed in another article.  Many times we find that our clients are fearful immediately after a car accident as there might have occurred without warning.  Hopefully this fear goes away.  However, if it does not, one might need to seek professional help to deal with what may be an anxiety of driving phobia.

There are special situations where a person who was not involved in the car accident can recover monies for emotional distress.  This is usually restricted to family members who actually see and at the same time are aware of the accident (an unfortunate example, when a parent was watching his two children cross the street in a marked crosswalk, when without warning, a car moved and struck one of the children).
