Government Orders Recall Of Over 1 Million High Chairs

The Consumer Product Safety Commission (CPSC) announced a voluntary recall involving Atlanta’s Graco Children’s Products, Inc., a prominent maker of children’s and baby products.  About 1.2 million high chairs have been recalled due to a potential fall hazard.

Certain parts of the Graco Harmony-MT can become loose and cause the chair to fall over.  These dangerous tip overs have resulted in over 20 reports of children’s injuries ranging from bumps and bruises in some children to a hairline arm fracture in another.  The government issued the recall to prevent any further children’s injuries as reported by the Associated Press.

The CPSC investigated the design of the high chair and found that screws holding the front legs of the high chair can become loose and fall out.  Plastic brackets can then crack and cause the chair to tip over unexpectedly causing injury.  Consumers who already own those chairs were advised to stop using the chairs immediately.

A statement released by the Graco company stated that “In the case of Harmony, we have worked closely with the CPSC to identify and provide an appropriate fix.  We are confident that we have come up with a solution that will improve the performance of this chair.”

Grandpa Personally Injures Toddler By Backing Out Car

At Serious Accident, we usually advocate for less technology in cars so that driver distractions occur less often.  But in the case of back-bumper sensors and cameras, there might be good cause for installing them.

That’s what experts are saying after a Mountain View man personally injured his grandson by backing up his SUV out of the driveway and hitting the 18-month old boy, reports San Diego 6 News.  The man claims to never have seen his grandson, who managed to unlock his grandparents front door and darted behind the SUV before the pedestrian accident. Baby Slings Warned By CPSC Amid Wrongful Deaths

A Consumer Product Safety Commission (CPSC) investigation found at least 13 wrongful deaths have been a result of sling-style infant carriers in the last 20 years.  Another case involving a wrongful death is still being investigated, and the CPSC determined that 12 of the 13 wrongful deaths were with babies younger than four months old.

Parents and caregivers are advised to be careful when they use infant slings for babies younger than four months because many of the babies who died in the slings were either a low birth weight twin, had a cold or were born prematurely. Read the full article →


Sacramento’s Largest Personal Injury Settlement Awarded

An Oregon girl that was accidentally run over by a truck driven by her father was awarded a $24.3 million personal injury settlement following a trial involving a semi-truck accident that happened in 2004.

Diana Yuleidy Loza-Jimenez was given the settlement by a Superior Court jury on March 5, 2010 from Freeway Transport, Inc., the Portland, Oregon trucking company a judge found responsible.  According to the Sacramento bar association, this personal injury settlement is the largest in Sacramento County history. Drunk-Driver Sentenced After Killing 9-Year-Old Passenger

San Diego’s 10 News has reported that the drunk-driver (DUI) involved in a Carlsbad accident that took the life a 9-year-old girl last summer has been sentenced to four years in state prison.

Graco Issues Stroller Recall

About 1.5 million strollers sold at Wal-Mart, Target and other retail chains are being recalled after reports of children’s fingertips being severed by the hinges.

The products liability recall issued by Graco Children’s Products, Inc. includes certain models of its Passage, Alano and Spree Strollers and Travel Systems.  The company based in Exton, Pennsylvania received at least seven reports of children who have put their fingers in a stroller’s canopy hinge as it was being opened or closed.  Five children had their fingers amputated and another two suffered cuts. U.S. To Go After Cadmium To Prevent Children’s Injuries

CA Company To Pay $25K Fine For Lead Contamination

A California company has been forced to pay a $25,000 civil fine for products liability reasons after allegedly repeatedly imported childrens’ products with high amounts of lead.

Excelligence Learning Corporation – a Monterey, California-based company – was fined because of high lead concentrations in about 33,000 units of their children’s products.  On December 4th, the Consumer Product Safety Commission determined that their products had unsafe high levels of lead. The stockings were hung, by the chimey with care, in hopes that St. Nicolas would soon be there…and bringing some medical remedies in his bag.  Why?  Because what is hanging on your Christmas tree could be hurting you and your family without even knowing it.

Several researchers in Utah have discovered that a number of Christmas ornaments manufactured in China contained a vapor that could lead to product liability claims down the line.  The discovery happened by way of a fluke, when researchers were conducting tests carcinogenic levels in ground water near houses and stumbled upon a mystery vapors, only to find that Christmas ornaments were emiting the dangerous chemical, which presented products liability concerns. Product Liability Concerns Sparks Biggest U.S. Crib Recall

NY Increases Penalties For DUI With Child In Car

The state of New York has recently passed the Leandra Rosado Law which makes it a felony to be driving under the influence of alcohol or drugs when a child is a passenger.  The law is named for Leandra Rosado, an 11-year-old girl who was killed by a parent of her friend who drove drunk and crashed her car in Manhattan. Dearborn Family Files Wrongful Death Claim Against Resort

The family of a 3-year-old child who drowned at a water park in Sandusky, Ohio is suing a water resort in connection with the wrongful death.

Hassan Itani drowned on August 2, 2009 at the Kalahari Resort in a 3-foot-deep kiddie pool in an outdoor portion of the resort.  According to the lawsuit filed in U.S. District Court in Toledo, Hassan was not wearing a life vest that was required by resort policies, and the park didn’t have enough lifeguards monitoring activity. $6.5M Settlement After Ford Seat Belt Paralyzed A Kid

CHP: Buckle Up California To Avoid Children’s Injuries

Not to sound like your mother, but the California Highway Patrol (CHP) wants you to remember to wear your seatbelt whenever you get into a car.

A November, 2009 press release from the CHP states that car accidents — where safety belts were used improperly — are the leading cause of death in California for children aged 14 years and under.  This includes instances where children were buckled up the wrong way or not using a seatbelt at all. Maclaren Recalls One Million Strollers Amid Children’s Injuries

Baby Food Products Liability Recall Linked To Botulism

A California-based food producer has issued a recall of baby food because of worry about possible botulism contamination.

Plum Organics of Emeryville, California recalled its carrot and apple portable pouch baby food sold individually at Babies-R-Us and Toys-R-Us.  The products liability recall is sold in 4.22-ounce pouches, a “best by” date of May 21, 2010 and a UPC code of 890180001221.

More Children’s Injuries Caused By Medical Side Effects

A new study comprised by researchers at Children’s Hospital in Boston that analyzed National Center for Health Statistics shows a large amount of children’s injuries and harmful medical conditions have been the result of drug side effects.

The researchers looked at data from a ten-year period (1995-2005) and determined that over 585,000 children had to be checked into the hospital for adverse drug events (ADEs).  Most visits from these children were to outpatient clinics, but a good amount (22 percent) were treated at ER departments. Johnson & Johnson Recalls Children’s Tylenol

A widely used product for reducing fevers and treating headaches in infants has been recalled after possible contamination was discovered in several different varieties.

Johnson & Johnson has voluntarily recalled 57 batches of infants’ and children’s liquid Tylenol products to prevent sickness from their products liability.  An inactive ingredient in the bottles failed to meet internal testing standards.  B. cepacia bacteria was also found in a portion of raw material that went unused.

Cedars-Sinai To Pay Med Malpractice Settlement

A jury in Los Angeles has ruled that Cedars-Sinai Medical Center must pay a medical malpractice settlement of $7.3 million.
